MyMoldDetective® products are not to be used for Post Remediation Verification Purposes.

Product Shipping:

Shipping rates are calculated by the carrier and determined by location. Upon checkout, you must specify a physical street address. Your item(s) will be shipped to the shipping address you provide. Please confirm the information you enter is correct before processing your order. Once your order has been prepared for shipment or has shipped we are unable to change the shipping address.

Once your order leaves our facilities, MyMoldDetective® will not assume liability for late deliveries, regardless of the delivery method you specify.

Occasionally, packages are returned as undeliverable. When the carrier returns an undeliverable package to MyMoldDetective®, we will contact you to make arrangements for reshipment at the cost of the customer.

Please note: MyMoldDetective® is not responsible for items damaged in transit by shipping carriers.

International Shipping: All products ship from the United States. Please be advised that our shipping prices given through our website are just an estimate and may be subject to change. The consumer is responsible for all clearance fees, duties and taxes determined by customs. Such fees are non-refundable in the event product is returned.

Product Returns:

MyMoldDetective® guarantees all merchandise against defects and faulty workmanship. Any shipping damage must be reported to the carrier for inspection and a claim filed by the recipient within 2 days of delivery of the shipment. If you find a problem with your purchase, call us at (866) 948.9056 and ask for the Returns Department, Monday through Friday between 8:00 AM to 5:00 PM Eastern Time within 48 hours of receipt. An RA (Return Authorization) number will need to accompany the return of the product.

For proper credit, items should be shipped prepaid and insured. Please enclose the original packing slip, and briefly explain your reason for the return. Also, indicate whether you would like a replacement, exchange or credit. If you do not have your packing slip, please include the reason for return and send the package to the following address:

Note: If poly-bag protecting samples has been opened, neither a credit nor an exchange will be granted.

A 15% restocking fee will be charged on all returns and exchanges.

Conditions and Exclusions:

Any warranty claim must be submitted to MyMoldDetective® within one (1) year of purchase, as evidenced by the sales receipt. You must use reasonable care in the operation and maintenance of the Mold Testing System (as further described below and in the other packaging materials).

This Limited Warranty shall not apply under the following conditions:

  • This Limited Warranty is not transferable; any Mold Testing System resold by the original Purchaser to a third party shall void this Limited Warranty.
  • Any disassembly of, tampering with, use of accessories or attachments not recommended by My Mold Detective, or unauthorized repair or alterations of the Mold Testing System shall void this Limited Warranty.
  • This Limited Warranty does not apply to parts that fail as a direct result of environmental influences, including, but not limited to, cold, heat, rain, excessive humidity, freeze damage, or use of improper chemicals.
  • This Limited Warranty does not cover failure due to accident, misuse, misapplication, negligence, ordinary wear, abuse, or any other failure to use the Mold Testing System in accordance with the instructions supplied with the product.
  • The Company shall be responsible for ground shipping charges to the location of the appliance (home) within the continental United States and Canada. Any duties, express or special shipping charges are at the expense of the Buyer.

Disclaimer of Other Warranties:

Except as provided in the Limited Warranty provided above, the Mold Testing System is provided “as is” without warranties of any kind, whether express or implied. To the fullest extent permissible, and pursuant to applicable law, MyMoldDetective® disclaims all warranties (except the Limited Warranty), express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. My Mold Detective makes no representations or warranties regarding the use of the products and materials in this Mold Testing System in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. However, some states do not allow limitations on warranties, so the above limitations or exclusions may not apply to you.

Limitation of Liability:

MYMOLDDETECTIVE® SHALL NOT BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE PRODUCTS OR MATERIALS CONTAINED IN THE MOLD TESTING SYSTEM OR THE PERFORMANCE OF THE PRODUCTS, EVEN IF MY MOLD DETECTIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Air Care Companies, Inc., My Mold Detective, LLC, and third-party accredited laboratories maintain a limited liability to the cost of analysis for laboratory reports.

However, some states do not allow limitations on the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

Indemnification:

By using this Mold Testing System you agree to indemnify, defend, and hold harmless MyMoldDetective®, its officers, directors, employees, agents, licensors and suppliers from and against all losses, expenses (including medical expenses and personal injury claims), damages and costs, including reasonable attorneys’ fees, resulting from (a) any violation of these terms and conditions, (b) any failure to use the Mold Testing System or any portion thereof in accordance with the instructions contained herein, (c) any failure to submit the samples to MyMoldDetective’s recommended laboratory for testing, (d) any misuse or unintended use of the product, and (e) your negligent or willful misconduct.

Confidential Information & Lab Analysis:

MyMoldDetective’s Air Testing System is designed, packaged and sold to be use as one comprehensive systems. As such, core information needed for the laboratory to perform the sample analysis is kept confidential until the analysis has been completed by a MyMoldDetective® partnered, nationally accredited laboratory. MyMoldDetective’s color-coded, easy-to-read laboratory report will contain all critical information and specifications used by its partnered, third-party, nationally accredited laboratory to analyze your samples. (i.e. air flow rate, total sampling volume, debris rating of the samples, etc.) MyMoldDetective® Air Sample Cassettes taken to non-partnered laboratories will not be able to be analyzed. MyMoldDetective® air sample cassettes must be analyzed by MyMoldDetective® partnered labs. Non-MyMoldDetective® cassettes can be used with MyMoldDetective’s air sampling pump, however, it is not recommended, it may affect the ability of the MyMoldDetective’s color-coded, easy-to-read laboratory report to populate online, and accuracy of results cannot be guaranteed. Please see aforementioned indemnification.

Important to Know:

It is important to understand that testing your air for elevated mold is a great first step in the process. Spore Trap air sampling is one tool in determining if your property has a mold condition. Determining if the property requires professional attention may require additional investigative measures and possibly consultation with a qualified Indoor Environmental Professional (IEP). Onsite assessments, additional testing, protocol development and professional remediation & 3rd Party Post Remediation Verification (PRV) testing may also be necessary to solve your properties mold issue.

This product is not to be used in replacement of Third-Party Post Remediation Verification Testing or “Clearance” documentation. My Mold Detective highly recommends contracting with a qualified IEP and or certified Mold Remediation Professional to assist you with the proper steps to take as a property owner in dealing with your mold issue.

MyMoldDetective® will not be held responsible for overloading of samples.

Laboratory Chain of Custody Discrepancies:

MyMoldDetective® communicates with its partnered laboratory on your behalf. If there are any questions or inconsistencies between the registration of your samples and the samples received at the laboratory, then MyMoldDetective® may correct any issues which are felt to be common or obvious mistakes and where the correct information is clear (i.e. a surface sample is registered as an air sample, MyMoldDetective® will correct the sample type on the chain of custody with the laboratory on your behalf.) 

Less common errors, or errors that are less clear as to what was intended may result in MyMoldDetective® reaching out to you as the customer for confirmation or guidance on how to handle your samples. (i.e. two samples are received and the serial number and room names are inverted. REGISTERED AS: Outdoor SN# 123456 & Bedroom SN# 987654, ACTUAL SAMPLES RECEIVED: Outdoor SN# 987654 & Bedroom SN# 123456). If a response is not received from you, the customer, within 24 hours, MyMoldDetective® will use its best judgement and when in doubt, defer to what is written/marked on the cassette as being correct and will thereby correct the chain of custody with the laboratory. 

Rare errors where what was registered online and what was received at the laboratory does not match to such a degree that an educated assumption cannot be made will result in either 1.) The delay in analysis of the entire order 2.) Partial Analysis of your order. (i.e. Six samples were registered and only five were received, MyMoldDetective® will have the lab proceed with analysis of the 5 received samples. – OR- Two samples registered and one of the samples is compromised/broken/missing, MyMoldDetective® will put the order on hold until you, the customer, can be reached for guidance on how you would like to proceed.)

MyMoldDetective® will not be held liable for any customer-caused errors in the chain of custody that cause either changes or delays in analysis, nor can MyMoldDetective® refund shipping charges for any samples requested to be cancelled by the customer for any reason. MyMoldDetective® trusts and assumes its customers register their samples correctly, review the confirmation page thoroughly, and correct any errors, prior to completing the registration process and sending in samples to the laboratory.

Tenant Usage of our Product:

MyMoldDetective® is available for renters and property owners. If you are a tenant and want to determine if you have an elevated mold condition inside your rental property My Mold Detective’s lab results can be very helpful. Understand that MMD’s lab analysis and lab interpretation does not take the place of comprehensive onsite mold investigation. Mold investigations are conducted by independent IEP professionals who will visit the property and provide a full visual onsite assessment, moisture readings, humidity readings, assessment of the mechanical system, identifying of moisture intrusions which could determine the cause of your mold issue. My Mold Detective is a great first step, the testing methodology is professional grade and reputable, but not intended to take the place of an IEP to determine if your living space is safe for occupancy. Please consult with a qualified IEP if you want to know if your property is unsafe for occupancy. Visit: www.acac.org

You’ll find that many IEP’s are hesitant in working with renters. Mold investigations typically require a property owner’s approval in order to conduct and ultimately release the findings of their investigation.

Returning Samples to Partnered Laboratory:

MyMoldDetective® will not assume liability for late deliveries, regardless of the delivery method you specify. If your sample results are time-sensitive, MyMoldDetective® strongly recommends shipping samples via a tracked method.

ANNUAL PUMP CALIBRATION AND SERVICE

In order to maintain a high degree of confidence in the operation of your MyMoldDetective® Air Sampling pump, MMD recommends that the pump is returned to MMD every 12 months for inspection and re-calibration. This service requires a minimal recalibration fee plus shipping to our offices.

Please contact MMD for additional details and notify us to expect receipt. Pumps will be returned within 5 business days after the date the pump is received by our office. Recalibration should be performed 12 months from the time of purchase.
